Puppy Purchase Agreement
This Puppy Purchase Agreement (“Agreement”) dated_____________, is between Matoskah Meadows Labradors (“Breeder”) and __________________ (“Buyer”).
Background
1. This Agreement is for the purchase of one AKC Registered Labrador Retriever puppy.
Breeder and Buyer agree as follows:
Article 1—Definitions
1.1 Definitions. The terms defined in the preamble and Background have their assigned meaning, and each of the following terms has the meaning assigned to it.
“AKC” means the American Kennel Club.
“Limited Registration” means the puppy/dog is registered with the AKC, but no litters produced by that puppy/dog are eligible for registration.
“Puppy” has the meaning set forth in Section 2.1.
“Full Registration” means the Buyer has full breeding rights of the puppy/dog.
“Deposit” means a non-refundable deposit in the sum of $300.
“Good Health” means the Puppy is free of serious illness or genetic defect that alters the life of the Puppy. Serious illness and genetic life altering defects will be defined by the common usage within the Labrador Retriever breeding industry. Serious illness and genetic life altering defects do not include umbilical hernia, external or internal parasites or bacteria, coccidiosis, giardia, undescended testicles, inverted vulva, underbite or overbite.
Article 2—Purchase Price and Description
2.1 Description of Puppy. Buyer agrees to purchase the following puppy (“Puppy”) from Seller:

2.2 Purchase Price. Buyer agrees to purchase the Puppy for $ with Limited Registration or $ with Full Registration (“Purchase Price”). Full Registration is at the full discretion of the Breeder. The Purchase Price must be paid in full at the time of picking up the Puppy from Breeder or upon transporting the Puppy to the Breeder. Ownership of Puppy will not transfer until Buyer has paid the Purchase Price in full. Buyer will not be allowed to pick up the Puppy or have the Puppy transported until the Purchase Price has been paid in full.
2.3 Deposit. Buyer agrees to pay Breeder the Deposit to hold the Puppy for Buyer to purchase. The Deposit will be credited towards the Purchase Price. Deposit must be paid immediately to Breeder in order to hold the Puppy for Buyer. Breeder reserves the right to void this transaction and refund the Deposit if Breeder learns of any reason why Buyer might not be suitable for the Puppy.
In the event a tragic accident occurs to the Puppy before being transported or picked-up by Buyer, the Deposit will be returned to Buyer, unless Buyer wishes to apply the Deposit to another puppy, if one is available, or to a puppy from the next available litter.
2.4 Payment Method. Payment for the Deposit and Purchase Price can be paid by PayPal, Zelle, Venmo, or cash.
2.5 Transportation. If transportation is required, Breeder will help to organize the transportation of the Puppy to Buyer. Buyer is responsible for the transportation costs.
If the Buyer is not able to pick up the Puppy on the agreed upon transportation or pick-up date, Breeder may charge a $5 per day boarding fee for the care of the Puppy for every day the Puppy remains in Breeder’s care after the scheduled transportation or pickup date. Buyer will not be allowed to pick up the Puppy or have the Puppy transported until the Purchase Price and boarding fees have been paid in full.
Article 3—Health Guarantee
3.1 Initial Health Guarantee. Breeder warrants that the Puppy is in Good Health at the time of pickup or transportation. Puppy will have its first vaccine and health examination by the Breeder’s veterinarian and a series of deworming treatment. To qualify for the guarantee Puppy is to be registered with a AKC certificate, not just a AKC application. ‘Matoskah Meadows’ must be included in the registration name.
3.2 Terms of the Initial Health Guarantee. Buyer agrees to not take the Puppy to public places or spaces until the Puppy is fully vaccinated. If Buyer takes the Puppy to public place(s), the initial health guarantee is void. Public places or spaces include but is not limited to, dog parks, public parks, pet stores, groomers, daycare, public stores, neighborhood sidewalks, etc.
A licensed veterinarian must examine the puppy within 48 hours, at Buyer’s expense, of Buyer picking up the Puppy or upon delivery of the Puppy if transported to Seller. Upon finding by a licensed veterinarian that there is a serious illness or genetic defect that alters the life of the Puppy, the Buyer must notify Breeder immediately, but no later than 24 hours of discovering the serious illness or genetic defect. The Puppy must be returned to Breeder within 24 hours if there is serious illness with the Puppy to ensure the Puppy receives proper care, or within 72 hours if there is a genetic defect with the Puppy. Breeder reserves the right to have the Puppy examined by a licensed veterinarian of its choice at the expense of Breeder. Should there be a discrepancy between the Buyer’s and Breeder’s licensed veterinarian findings, Breeder’s veterinary findings shall control. If Buyer does not see a licensed veterinarian within 72 hours of receiving the Puppy, the initial health guarantee is void.
3.3 24 Month Hip and Elbow Guarantee. Breeder warrants the Puppy to be free of hereditary hip and elbow dysplasia for 24 months from the date of birth. If the Puppy is found to have hereditary hip and/or elbow dysplasia with in the 24-month guarantee from examination of a licensed OFA/PennHip veterinarian, the Buyer must submit to Breeder a written report from the licensed veterinarian and accompanied by x-rays and other testing as appropriate. The Puppy must not have suffered any trauma prior to the examination. Breeder reserves the right to have the Puppy examined by a licensed veterinarian of its choice. If Puppy is spayed or neutered before two (2) years of age, the hip and elbow guarantee is good for only 12 months from the date of birth.
3.4 Breeding Soundness. Breeder does not guarantee breeding soundness when Puppy is sold with full AKC registration.
Article 4—Buyer Obligations
4.1 Health of the Puppy. Buyer agrees to continue to keep the Puppy healthy, maintain and stay current with all puppy vaccinations and deworming, provide periodic vet checks, including an initial examination within 72 hours after delivery or pick-up of the Puppy. Buyer agrees to conduct parasite testing and treatment with their licensed veterinarian.
Buyer agrees to feed a high-quality dog/puppy food to the Puppy and to not allow the Puppy to become obese. Buyer agrees to consult with a licensed veterinary on the proper diet for the Puppy as it grows.
Buyer agrees to give the Puppy proper exercise and shall not start agility, heavy or competitive field training or any activity which may damage the puppy’s bones or muscle structure until the Puppy has reached a minimum of 18 months.
4.2 Obedience class and socialization. Buyer agrees to enroll into a basic obedience class and/or puppy obedience class after the Puppy is fully vaccinated by Buyer’s veterinarian.
Buyer agrees to provide regular socialization for the Puppy after the Puppy is fully vaccinated. Buyer agrees to provide a safe environment for the Puppy.
4.3 Registration Papers. Buyer agrees to send in Puppy’s registration papers to the AKC. “Matoskah Meadows” must be included in the Puppy’s AKC registered name. If there is a delay from AKC Buyer will be provided Puppy’s AKC application within 7 months time to allow AKC proper processing time.
4.4 Spaying or Neutering. If Puppy is sold on Limited Registration, Buyer shall spay or neuter Puppy at the age Buyer’s licensed veterinarian recommends. Buyer understands Breeder recommends waiting until 24 months of age.
4.5 Prohibited Uses or Activities. Buyer agrees that the Puppy shall never be used for fighting or sold or given to a puppy mill.
4.6 Right of First Refusal. In the event Buyer is unable to properly care for the Puppy, it is agreed that the Breeder shall have the first rights to the Puppy. Buyer agrees that the Puppy will never be placed in a dog pound, shelter, or rescue center.
Article 5—General Provisions
5.1 Governing Law. This Agreement and all disputes arising out of or in connection with this Agreement shall be governed by the laws of Michigan, without regard to conflict of law principles. The parties to this agreement will submit all disputes arising under this Agreement to arbitration in Washtenaw County, Michigan in accordance with the rules of the American Arbitration Association (“AAA”).
5.2 Merger. This Agreement constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior or contemporaneous agreements, negotiations, discussions and understandings, written or oral, between the parties with respect to such subject matter.
6.3 Assignment. Neither party may assign, transfer, or subcontract any obligations (or rights) under this Agreement without the prior written consent of the other party.
6.4 Amendments. No changes, modifications or waivers to this Agreement will be effective unless in writing and signed by both parties.
6.5 Severability. If any provision of this Agreement is determined to be illegal or unenforceable, that provision is severed from this Agreement and the other provisions remain in effect and enforceable.
6.6 Execution of Counterparts and Electronic Signature. This Agreement may be executed in any number of counterparts and such counterparts together shall constitute the same instrument. This Agreement may be executed by electronic signature, which shall be considered as an original signature for all purposes and shall have the same force and effect as an original signature.
OUR HEALTH GUARANTEE
The Seller Matoskah Meadows Labrador’s, guarantees Your Puppy to be free from infectious diseases for two days after the puppy leaves our premises and guarantees the Puppy to be free from genetic problems for up to two years of age unless altered before two years of age then one year guarantee. Hip and joint problems can be caused by or influenced by overfeeding, improper diet, failure to maintain proper weight, failure to provide sufficient exercise, over-exercising or improper exercising which would be out of our control.
The guarantee of the hips does not cover problems that are environmentally induced. The purchaser should take great care in bringing up the Puppy. The Puppy should not be allowed to jump from great heights taller than himself (for example avoid jumping off a porch or out of a truck), or run up and down stairs or do a lot of running and sliding on slick surfaces or be subjected to strenuous exercise or overly long games of fetch. Before a pup reaches about age 15 months, his tendons are not strong enough to bear weight from impact…lax tendons allow the head of the hip bone to bang into the hip socket causing trauma to cartilage and bone. This type of injury or impact can cause hip dysplasia and elbow problems. Seller will not be responsible for this kind of damage. Should the Puppy develop hip dysplasia even after proper care and proper food, then the pup will be replaced with a pup of equal or greater value from the next litter. We will not replace a pup until we have received a copy of the x-rays accompanied by a letter from the vet. This letter should also include proof of regular vet visits that documented a healthy maintained weight up until the diagnosis of HD. After we have reviewed the x-rays, we reserve the right to forward the x-rays to our Vet or to OFA for further evaluation before the pup is replaced. We will replace a pup only once such an occurrence is highly unlikely in the first place if proper care is given. This replacement does not include the cost of transportation or medical-related expenses.
We do not guarantee temperament. We breed only from dogs that have demonstrated great stable temperament. We take great pride in providing a secure, loving environment for our Puppies from birth and provide daily proper socialization. After Delivery, the responsibility is on the Buyer to provide a good environment with proper socialization. It is the Buyer’s responsibility to keep the Puppy free from harm and bad interactions with other people, dogs and animals. Any negative exposure of the puppy to a bad experience with other dogs or people can cause lasting effects. Be gentle with your Puppy and use Positive Reinforcement (Praise him when he does “good” - ignore his mistakes, don’t be overly negative) to train him. We highly encourage all puppies to go through at least a basic obedience course by the time they are a year old.
The Buyer agrees to continue providing regular socialization for the Puppy after the pup is fully vaccinated. The purchaser agrees to provide a safe environment. We do not consider a rope or chain tie out or letting the Puppy run wild to be safe or appropriate.
The buyer agrees to keep the Puppy healthy, maintain and stay current with all puppy vaccinations, provide periodic vet checks including an initial examination within two business days after delivery.
Seller will provide Buyer with a puppy that leaves Matoskah Meadows Labrador’s care clean; in good general health and that has no known physical defects. De-worming at 2, 4, 6 and 8 weeks and first immunizations at 6 weeks of age will have been completed and detailed in writing. It is generally recognized that intestinal parasites (worms, coccidia, etc) are common in puppies and are a part of a puppy’s early development we make every effort to prevent and treat parasites. Often, however, the stress of change and travel can cause intestinal parasites to emerge. Buyer agrees to continue parasite testing and treatment (if necessary) with their veterinarian.
Genetic defects that effect quality of life are covered by this guarantee for two years, including hips and eyes. A written examination from a veterinarian must state that genetic defect exists and be accompanied by x-rays and other testing as appropriate. If altered before two years of age this contract is only one year guarantee.
Buyer agrees that he/she will take their puppy to their veterinarian within two business days of receiving the Puppy for examination. Documentation by veterinarian, that is dated within two business days of Buyer’s receipt of the Puppy, that shows serious untreatable infectious illness or genetic defect which is sufficiently serious in the opinion of two qualified veterinarians, at least one of whom is selected by the Seller, to warrant euthanization of the dog. Buyer will be refunded the price of the Puppy or given a replacement Puppy from the Seller’s next available litter. Transportation costs (if any) will not be refunded and are not included in this guarantee. Expenses of treatment, exams and tests are the financial responsibility of the Buyer.
Failure to have the puppy examined by a vet within two business days of the date the puppy is delivered to Buyer or if Buyer fails to provide required immunizations, treatment or de-worming, will mean that this health guarantee will be void.
FIRST RIGHT OF REFUSAL
Should the Buyer find they are unexpectedly in a circumstance where death or other loss prevents them from being able to properly care for the Puppy, Buyer agrees that we will be contacted first and given first rights to the Puppy. If the dog is to be sold, Seller will be given right of first refusal. Buyer agrees that the Puppy will NOT under any circumstances be placed in a dog pound or rescue center. This provision is to ensure that the Puppy will not end up homeless or destroyed.
